General terms and conditions of 14.02.2018

The following general terms and conditions also contain legal information about consumer´s rights according to the provisions on distance selling contracts and contracts in accordance with the provisions on distance contracts and contracts in electronic commerce.

1. Scope

The following general terms and conditions regulate the contractual relationship between the EDWIN MIEG OHG and the customers placing an order, who are consumer according to § 13 BGB (German Civil Code). The version of the general terms and conditions applicable at the time the order is placed is decisive. The customer's general terms and conditions are only considered if it has been separately agreed on in written form and a written confirmation has been ussued by to in writing and a written confirmation is provided by Edwin MIEG OHG.

3. Subject matter of contract
Subject matter of contract are "TIPP-KICK" trademark tabletop football games and associated accessories and merchandising.
Products equivalent in quality and price to the information provided on www.tipp-kick.com are provided. We reserve the right not to deliver if products are not available.

4. Conclusion of the contract
The contract shall be concluded in German as well as English.
The display of products in the online shop does not constitute a legally binding offer to conclude a contract; rather it provides a non-binding proposal for the submissions of offers. By clicking the "Send order" button, the buyer submits a binding offer to the EDWIN MIEG OHG to purchase the selected products.
The contract enters into force by the transmission of the written order confirmation by E-mail from the EDWIN MIEG OHG. Generally this takes place within two working days.

5. Storing the content of contract
The terms of the contract are stored by the EDWIN MIEG OHG upon the conclusion of the contract. The terms can be accessed by the buyer. The terms of contract may be printed or downloaded.

6. Revocation instructions

Right of revocation
You can revoke your contract declaration within 14 days without giving reasons in text form (e.g. letter, fax, e-mail) or - if the item was transferred to you before the expiry of the period - also by returning the item. The period begins after receipt of these instructions in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of identical goods, not before receipt of the first partial delivery) and also not before fulfilment of our information obligations pursuant to Article 246 § 2 in combination with § 1 (1) and (2) EGBGB (Introductory Act to the German Civil Code) and our obligation pursuant to § 312g (1) sentence 1 BGB (German Civil Code) in combination with Article 246 § 3 EGBGB. To comply with the revocation period, it is enough to dispatch the revocation or the item in time. The revocation must be addressed to:

Consequences of revocation
In the event of an effective revocation, the mutually received services/goods must be returned and any benefits derived (e.g. interest) surrendered. If you cannot return or surrender the services/goods and benefits received (e.g. benefits of use) or only in part or only in worsened condition, you must to this extent pay compensation. You only have to pay compensation for deterioration of the item and benefits derived if the benefits or deterioration are attributable to handling the item that goes beyond examination of the properties and mode of operation. Testing and trying out the particular item, as is possible and customary in a shop for example, is what is meant under "examination of the properties and mode of operation." Items that can be returned as a package must be returned at our risk. You must bear the normal costs of return if the goods delivered correspond to those ordered and the price of the item to be returned does not exceed an amount of 40 euros or, in the case of a higher price of the item, if you had not yet rendered counter-performance at the time of revocation or a contractually agreed partial payment. Otherwise, the return for you is free of charge. Items that cannot be returned as a package will be collected from you. Obligations for the reimbursement of payments must be met within 30 days. The period begins for you with the dispatch of your revocation declaration or the item, for us with its receipt.

7. Alternative settlement of disputes according to article 14. passage 1 ODR-VO and §36 VSBG
The EU Commission provides a platform for online dispute resolution which can be found here: https://ec.europa.eu/consumers/odr/. Consumers have the opportunity to turn to the Online Dispute Resolution website which is managed by the European Commission. We are willing to participate in this process of dispute settlement.

9. Due date and payment, default
The purchase price is payable immediately when placing the order. The buyer may pay the purchase price as an advance payment, PayPal payment or by credit card. If the customer defaults on payment, we shall charge interest of 5 % above the base rate set by the German Central Bank. The buyer reserves the right to demonstrate that a lower interest loss has occurred.

10. Reservation of ownership
The delivered products shall remain the property of EDWIN MIEG OHG until all outstanding claims against the buyer have been settled.

11. Limitation
The period of limitation amounts to twenty four months.

12. Data protection
EDWIN MIEG OHG shall only collect buyer data with obtaining the buyer's permission for data required to execute the order and the contract. EDWIN MIEG OHG shall only use the data provided by the buyer for the purposes agreed in connection with the concluded contract.

13. Governing law
German law is applicable excluding the UN Convention on Contracts for the International Sale of Goods.

14. Place of jurisdiction
The place of jurisdiction for all disputes arising from the purchase contract and the general terms and conditions is Villingen – Schwenningen (Villingen – Schwenningen District Court).

15. Severability clause
If one or more provisions from these general terms and conditions are in its interity or in part ineffective, this shall not impact the effectiveness of the general terms and conditions.

16. Ordering process
To place an order, first select the desired number of the relevant product from the menu. Subsequently click the "Into the goal" button. The desired product is placed in the cart. The content of the cart can be viewed by clicking the "Display cart" lettering.
The "Checkout" button must be clicked to submit a binding order. The cart provides an overview of the selected products as well as the prices and any shipping costs. Clicking on the cross under the "Delete" heading lets you remove the selected products from the cart. The invoice address and the shipping address must be indicated by the buyer. The bold mandatory fields must be completed. By clicking on the "Send order" - button the order is complet. The ordering process can be cancelled at any time by closing the browser window.
